1. Acceptance

These Terms of Use govern your use of www.musicmakerlaw.com (the "Site"), operated by Novick Law PLLC, a Tennessee professional limited liability company with its principal office at 818 18th Ave. S., Floor 10, Nashville, TN 37203, practicing under the name Music Maker Law ("the Firm," "we," "us," "our").

By accessing or using the Site you agree to these Terms. If you do not agree to them, please do not use the Site. Our Privacy Policy is incorporated into these Terms by reference.

2. Attorney advertising

This Site is attorney advertising under the rules of professional conduct of the jurisdictions in which we are admitted. It is not a solicitation for any specific matter and is not intended to solicit clients in any jurisdiction where we are not licensed to practice.

Prior results do not guarantee a similar outcome. Descriptions of our experience, awards, rankings, and client recognitions reflect past work only. Every matter turns on its own facts, and nothing on this Site is a promise, guarantee, or prediction about the outcome of yours. Listings and honors are conferred by third parties according to their own criteria, and we do not pay for or control those criteria.

3. The Site is not legal advice

Everything on this Site is general information about the Firm and its practice. It is not legal advice, it is not tailored to your circumstances, and you should not act or refrain from acting on the basis of it.

Legal rules change, differ by jurisdiction, and turn on facts. Information on this Site may be incomplete or out of date, and we do not undertake to update it. Consult a lawyer licensed in your jurisdiction about your specific situation.

4. No attorney-client relationship

Using the Site, reading its contents, or sending us an email does not create an attorney-client relationship and does not make you a client.

An attorney-client relationship with the Firm arises only when we have cleared conflicts and both parties have signed a written engagement agreement. Until then, information you send us may not be protected by the attorney-client privilege, and we may already represent someone whose interests are adverse to yours.

Please keep any first message to your name, contact details, and a general description of the matter. Do not send documents, contracts, or detailed facts before an engagement is in place. Email is not a secure channel.

5. Where we are licensed

Daniel M. Novick is admitted to practice law in New York, Tennessee, and California. We do not practice in jurisdictions where we are not admitted, and nothing on this Site should be read as an offer to do so. Where a matter requires it, we associate with counsel admitted in the relevant jurisdiction.

6. Permitted use

You may view, download, and print pages of the Site for your own personal or internal business reference.

You may not:

  • Use the Site for any unlawful purpose, or in a way that interferes with its operation or with anyone else's use of it.

  • Copy, republish, distribute, or create derivative works from the Site's content for commercial purposes without our written permission.

  • Use automated means to scrape, harvest, or collect content or contact information from the Site, including for the purpose of sending unsolicited communications.

  • Use any content from the Site to train a machine-learning or artificial-intelligence model.

  • Attempt to gain unauthorized access to the Site or to any system or network connected to it.

  • Frame the Site, or present its content as your own or as endorsed by anyone we have not endorsed.

7. Intellectual property

The Site and its contents — text, layout, photographs, graphics, and the Novick Law PLLC and Music Maker Law names and logos — are owned by the Firm or its licensors and are protected by copyright and trademark law. Nothing on the Site grants you a licence to use our names, logos, or trade dress.

If you believe content on the Site infringes your copyright, write to us at the address in Section 13 with enough detail to identify the work and the material in question, and we will respond promptly.

8. Nothing is sold through the Site

We do not sell products or services through the Site. The Site takes no orders, no payments, and no account registrations. Fees for legal services are set out in an engagement agreement, not here.

9. Third-party links

The Site may link to sites we do not control. We provide those links for convenience only. We do not endorse those sites, we are not responsible for their content or their privacy and security practices, and your use of them is at your own risk and subject to their terms.

10. Disclaimer of warranties

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that the Site will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components.

We do not warrant that information on the Site is accurate, complete, or current.

11. Limitation of liability

To the fullest extent permitted by law, neither the Firm nor any of its members, employees, or agents will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, business, data, or goodwill, arising out of or relating to your use of or inability to use the Site, whether based in contract, tort, strict liability, or any other theory, and whether or not we were advised of the possibility of such damages.

Nothing in these Terms limits any liability that cannot lawfully be limited, and nothing in them limits or alters the professional obligations we owe to our clients, which are governed by the applicable rules of professional conduct and by the client's engagement agreement.

12. Governing law, venue, and general terms

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or to the Site will be brought exclusively in the state or federal courts located in Davidson County, Tennessee, and you consent to the personal jurisdiction of those courts.

We may change the Site or these Terms at any time. Changes take effect when posted, with a revised "Last updated" date, and your continued use of the Site after that constitutes acceptance. Nothing in this section limits the notice we give about changes to our Privacy Policy.

If any provision of these Terms is held unenforceable, the rest remains in force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and the Firm regarding the Site.
